Terms and Conditions
Subject-matter of the agreement
The subject of this Agreement is the regulation of interaction between the user and the Netgame Casino in all aspects of play norms for real and virtual money, as well as fulfillment of financial transactions and participation in promotions and bonus offers.
Netgame Casino is owned and operated by Netgame Entertainment N.V., a limited liability company incorporated under the laws of Curacao, bearing company number 127096 and having its registered address at E-Commerce Park Vredenberg, Curacao, Netherlands Antilles. It is licensed and regulated in virtue of licence №8048/JAZ2012-011 issued by the Gaming Commission of Curacao.
Payments are processed by Privaline Holdings LTD, registered at the following address: Vasili Michailidi 9, 3026, Limassol, Cyprus, as per agreement between Privaline Holdings LTD and Netgame Entertainment N.V.
Paysafe Payments are processed by Netgame Entertainment N.V.
By using and/or visiting any section of the website www.netgamecasino.com (hereinafter referred to as the "Website"); or by opening an account on the Website, you agree to be bound by:
1.1.1 The General Terms and Conditions, on this page;
1.1.3 AML Policy;
1.1.4 Any game rules;
1.1.5 Any terms and conditions of promotions, bonuses and special offers which may be found on the Website from time to time.
1.2 All of the terms and conditions listed above shall together be referred to as the "Terms".
1.3 Please read the Terms carefully before accepting them. If you do not agree to accept and be bound by the Terms please do not open an account or continue to use the Website. Your continued use of the Website constitutes acceptance of the Terms.
2.1 The Terms shall be agreed between You (the "Player") and the Operator.
2.2 The Website, the prices contained in it and the Terms are translated into a number of languages and are therefore intended to be used by the citizens of the relevant countries and other countries which speak those languages.
2.3 References in the Terms to "us", " our" or " we" are references to the Operator.
2.3.1 in the case of terms and conditions relating to monies held in Your Account from time to time, to any Operator Group company which holds such money and shall (where appropriate) be deemed to include our agents, partners, and suppliers.
CHANGES TO THE TERMS
3.1 We may need to change the Terms for a number of reasons, including for commercial reasons, to comply with new laws or regulations or for customer service reasons. The most up-to-date Terms can be accessed here.
3.2 When we make changes to the Terms which we wish to notify you of, we will do so by e-mail or by placing a notice on the Website, the Player may need to re-confirm acceptance before the changes come into effect and he is able to place bets on our website.
OPENING YOUR ACCOUNT
4.1 In order to place a bet via the Website, you will need to open an account on the Website ("Your Account").
4.1.1 You may create an account in one of the following currencies: EUR, USD, CAD, AUD, NZD, NOK, RUB, INR, PLN, JPY, UAH.
4.2 Registration in the casino is available for persons who have reached the age of majority, according to the current legislation of the state of which they are citizens. As a rule, it is 18 or 21 years. Persons under the specified age are strictly prohibited to register the account.
4.3 For various legal or commercial reasons, we do not permit accounts to be opened by, or used from, customers based or domiciled in certain jurisdictions. When attempting to open an account or using the website it is the responsibility of the player to verify whether gambling is legal in that particular jurisdiction. In Annex A you can find the list of the countries from where the customers are not allowed to play and open an account in netgamecasino.com. Also in this list are indicated states, users of which are allowed / prohibited to use of certain specific games.
4.4 Registration of an account in a casino for real money play by Netgame Casino casino employees, affiliates, their relatives and close persons is strictly prohibited and is considered by the administration as fraud. If such an account is found in the casino, both the account in the casino and the account in the affiliate program are blocked.
4.5 One individual can have only one gaming account in the casino. Creating multiple accounts per person, per family, per home, IP address, computer or mobile device, to an account in a payment system or a bank card is strictly prohibited and is considered by the casino administration as fraud. If such accounts are found, the Casino reserves the right to cancel the winning amount and return to the user the amount of the last (winning) deposit. After performing these actions, the account is blocked without the possibility of recovery.
4.6 You hereby acknowledge and accept that you may both win and lose money by using the services at the Website.
4.7 When you open Your Account You will be asked to provide us with personal information, including your name, date of birth, and appropriate contact details, including an address, telephone number and e-mail address. The user must fill in all the fields in the "My Data" tab, taking into account paragraph 4.8 of these Rules.
4.8 The user is obliged to indicate reliable information in the "My Data" tab, which completely coincides with the information in the passport / ID card / other similar documents.
4.9 After registering the account, the User is aware that such data as account currency, name, surname, nickname and date of birth can not be edited or changed.
4.10 By clicking the "Register" button on the Netgame Casino Casino website, the User confirms that he has fully read the text of the user agreement and agrees to unconditionally comply with all conditions and rules.
4.11 The administration of the Netgame Casino casino believes that all actions and transactions that occur in the account are made by the owner of the account.
4.12 By registering the account, the User is aware that the Netgame Casino Casino can conduct checks to verify the identity of the User, contact and payment information. To confirm the authenticity of the information specified in the User's profile, the casino has the right to request documents confirming the identity of the User, as well as to apply additional requirements. 4.13 If any information provided by the User is false, inaccurate or misleading, it is considered that the User violates the terms of the User Agreement and the Netgame Casino has the right to close the User's account immediately and / or refuse the User to use the services of the Website in addition to Any other action at its discretion.
4.14 Your Account must be registered in your own, correct, name. You may only open one account. Any other accounts which you open with us in relation to the service and the Website shall be "Duplicate Accounts". Any Duplicate Accounts may be closed by us immediately and:
4.14.1 all transactions made from the Duplicate Account will be made void;
4.14.2 all stakes made using the Duplicate Account shall be voided and deposits will be returned to you;
4.14.3 any returns, winnings or bonuses which you have gained or accrued during such time as the Duplicate Account was active will be forfeited by you and may be reclaimed by us, and you will return to us on demand any such funds which have been withdrawn from the Duplicate Account.
4.15 You must maintain your account and keep your details up-to-date.
4.16 If you wish to close your account you must send a request to do so to the support.
USERNAME, PASSWORD AND CUSTOMER INFORMATION
5.1 After opening Your Account, you must not disclose (whether deliberately or accidentally) your username and password to anyone else.
5.2 The user must store his registration information in a place that is not accessible to third parties.
5.3 The user is obliged to inform the casino administration about the misuse of his account by third parties, in the shortest possible time by any available means. In this case, the account is immediately blocked until it is unlocked by the verified owner. The casino is not responsible for the actions of third parties until the account is locked.
5.4 If you have lost or forgotten Your Account details you may retrieve your password by clicking on the "Forgot Password" link below the login portal.
DEPOSITS AND WITHDRAWALS FROM YOUR ACCOUNT
6.1 If You wish to participate in the services, You must deposit monies into Your Account from an account or source of which You are the account holder. Such monies may then be used by You to play games. The user is obliged to deposit funds into his / her account only from his / her account in EPS, bank card or phone. If You use a payment method in respect of which You are not the account holder, we reserve the right to treat any deposit into the Account as being invalid (and any winnings arising from such deposit as void) pending the satisfactory completion of all relevant Checks. In case of revealing the facts of violation of this condition, all winnings can be canceled, and the amount of the last (winning) deposit will be returned to the account / account from which it was made. After performing these actions, the account is blocked without the possibility of recovery. It is forbidden to deposit funds into the game account by third parties: friends, relatives or partners. This rule also applies to the withdrawal of funds.
6.2 The user assumes full responsibility for using the Netgame Casino software, as well as for possible financial risk when playing for real money.
6.3 The user is the only party that is responsible for the legality of using the gambling service by his own, according to the current legislation of the state of which he is a citizen.
6.4 Internet gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to complete this transaction.
6.5 When depositing funds to the account, the user must exactly follow the steps available in the instructions for making deposits and in the "Cashier" section. Ignoring the explicit prohibitions and restrictions specified in this section, removes from the casino responsibility for not listed funds. When making a deposit before the notification of successful payment, the user should not click the browser control buttons, namely "Update" and "Back". This can lead to a failure in the transaction.
6.6 If there is a proven malfunction in the software of the casino and its partners, the Netgame Casino administration is entitled to charge improperly credited funds from the user's accounts and also undertakes to refund all amounts incorrectly written off or not accrued to user accounts within 7 days since such a failure.
6.7 To deposit funds to the balance of the account in the Netgame Casino Casino, the user must: go to the "Cashier" page, select the payment method, specify the payment amount and make the payment, following the instructions on the payment page. In more details the terms of funds transfer are indicated on the page "Methods of payment". We are not responsible for any delays in the processing of payments arising after the application for withdrawal of funds was processed by our managers.
6.9 After submitting an application for withdrawal, the funds are debited from the gaming account for carrying out the withdrawal transaction. The user can independently check the status of the request for withdrawal and cancel it if necessary. After the cancellation of the withdrawal request, the funds will be automatically credited to the account.
6.10 If the User finds incorrectly filled details in the application for withdrawal of funds, he must independently cancel the application, if it has not yet been processed. The user is aware that after processing the withdrawal request, the funds will be sent to the requisites specified in the application. The casino does not have to check the availability of cards, wallets in the EPS and phone numbers to which the user issues a withdrawal, but in the event of improperly specified details, we will try to assist in the return of funds, if it is possible.
6.11 When the payment is made, the user is notified of the transaction.
6.12 The casino pays the winnings in the same currency and by the same payment method with which the main account was replenished (deposit was made). Exceptions are cases where such a transaction is not possible for technical reasons or financial constraints. The final choice of method, timing and currency for payment is made by the administration of the Netgame Casino casino.
6.13 When an application for withdrawal of funds is processing, the casino reserves the right to verify the account in order to exclude violations by the User of these Rules. To do this, the user must provide an identity document and / or other required documents.
6.14 The casino does not charge commissions for making a deposit and withdrawing funds. Commissions can be levied by banking institutions and payment system operators, which the casino administration can not influence. Exceptions are cases when the turnover of funds (the amount of rates) is less than the triple deposit amount. In this case, the administration of the casino Netgame Casino reserves the right to charge a commission of 6-10% of the withdrawal amount (deposit) to compensate for the costs of making payments.
6.15 In case if the User is suspected in in fraud or fraudulent activity, or convicted of it, the casino reserves the right to block the account of the User at any time, without prior notice. In this case, we disclaim the obligation to return or otherwise compensate the User for funds on the balance of the account in the casino. We also reserve the right to inform the relevant authorities about this.
6.16 All incoming and outgoing payments of the Netgame Casino casino are conducted through the software and accounts of the casino's financial partners.
6.17 We are required by our licence to inform customers about what happens to monies which we hold on account for You, and the extent to which such monies are protected in the event of insolvency. Monies deposited by You to Your Account will be held in a bank account and/or escrow account which will be kept separate from our company funds. Monies in Your Account are not insured, guaranteed, sponsored or otherwise protected by any deposit or banking insurance system or by any other similar insurance system. As such, monies in Your Account are not protected in the event of insolvency. This meets the Gambling Commission's requirements for the segregation of customer funds at the level: basic segregation.
6.19 You can set a deposit limit on Your Account in any one day. This limit cannot be increased without giving us twenty-four hours' notice of Your wish to increase Your deposit limit and only when twenty-four hours have elapsed from Your request for such an increase will the increase apply.
6.20 Subject to the Closure of Your Account, You may request withdrawal of funds from Your Account at any time provided that:
6.20.1 all payments made into Your Account have been confirmed as cleared and none have been charged-back, reversed or otherwise cancelled;
6.20.2 any Checks referred to the Verification of Your Identity; Money Laundering Requirements above have been completed by us to our satisfaction;
6.20.3 You have complied with any other relevant withdrawal conditions affecting Your Account (e.g. any applicable Bonus Terms).
6.21 On any withdrawal approved by us, provided that You give us sufficient information as to how the funds should be transferred to You, we will return the relevant funds to You in accordance with paragraph 6.6 (less charges incurred or any other amount required to be deducted from Your withdrawal in order to comply with any applicable law).
6.22 We will attempt to accommodate Your request regarding the payment method and currency of payment of Your withdrawal. This, however, cannot be guaranteed. Therefore, we may process and pay withdrawals in a different payment method than the one requested by You, such as through different payment providers, a bank draft or wire. Similarly, in certain cases, the currency of Your withdrawal may not be the currency in which Your deposit was made or that was otherwise requested by You.
6.23 Inactive Account Fee. If You do not use Your Account for gaming, making a deposit, withdrawal or transfer, or if it is otherwise inactive, for a period of at least 13 consecutive months then it will be an "Inactive Account". All Inactive Accounts will incur a fee ("Inactive Account Fee"), the details of which can be found in the Website. We will notify You when Your Account becomes an Inactive Account, and at least 14 days before any Inactive Account Fee is deducted from it.
PLACING A BET OR GAMING
7.1 All transactions will be concluded in the language from which you placed your transaction.
7.2 It is your responsibility to ensure that the details of any transaction are correct.
7.3 You can access your transaction history on the Website.
7.4 We reserve the right to refuse the whole or part of any transaction requested by you at any time in our sole discretion. No transaction is accepted by us until we have confirmed to you that it has been accepted. If you do not receive a confirmation that your transaction has been accepted, you should contact Support team.
7.5 Once your bet is confirmed, you cannot cancel the transaction without our written consent.
8.1 The Company rewards its loyal and regular players by giving them a possibility to gain the player points (“Comp Points”) that the customer can transfer into Your Accounts hence obtaining real money for free to play with real bets with the possibility to win real money. From the moment the customer starting to play and place your first bet the customer will begin to accumulate complimentary points.
8.2 At any time, if desired, the user can exchange CP for real money, which will be credited to the Main balance.
8.3 The loyalty program applies to all casino users from the moment of their registration.
8.4 Depending on the number of bets placed in different games that are divided into categories with the multiplier, the customer get a certain number of Comp Points:

8.6 The user can receive an increased number of CPs for bets according to the advertising or promotions in casino. The list of games, dates and other detailed conditions for conducting such a promotion will be announced in an information message (e-mail, SMS, promo-page of the promotion).
8.7 Depending on the number of Comp Points accumulated during game, the customer will be awarded with the certain status.
8.8 If the customer do not confirm his email address the customer will not have an opportunity to convert Comp points to his Cash Balance.
8.9 Depending on the status of the player we provide different Comp point conversion rate to credit them to user accounts and different withdrawal limits.
8.10 You can convert minimum 10 Comp points.
8.11 You can view the available Comp Points in the Profile section of Your Account.
8.12 In the event that the Company believes you are abusing or attempting to abuse a Comp Point or other promotion, or is likely to benefit through abuse or lack of good faith from the Terms adopted by the Company, then the Company may, at its sole discretion, deny, withhold or withdraw any Comp Point or promotion from you, or rescind any policy with respect to you, either temporarily or permanently, or terminate your access to the services and/or block Your Account. The Company shall be under no obligation to refund to you any funds that may be in Your Account other than the amount of your original deposit.
8.13 In addition to charging for bets, CPs can be earned by the user as a reward for winning the tournament.
8.14 The Comp Points given as a reward for the win in the tournament don't influence status of the Player.
PARTICIPATION IN TOURNAMENTS
9.1 General Bonus terms are applied to participate in the casino tournaments.
9.2 All registered players are able to participate in a tournament.
9.3 Casino runs themed tournaments based on payouts in the games.
9.4 Players will participate in a tournament after clicking a "join" button on a desired tournament and places bets according to the following conditions:
- in real game mode (not in demo mode);
- at the time the tournament is running;
- in a tournament game;
- bets must be equal or higher than a minimum bet requirement in a tournament.
9.5 The tournament table is updated in realtime. Players are ranked based on sum of their points in a tournament. Players receive points based on payouts they're getting in the game: 2, 15 or 100 points may be awarded for a win. Points are calculated as follows.
Example: your are playing with 1 EUR per bet and receiving a win of 20 EUR (the payout is x20 to the bet amount) – you will get 15 points in the tournament.
Tournament points are only credited for first 500 bets made in the tournament. Starting from 501's bet you are not going to get the tournament points.
9.6 Start/end time, minimum bet size, number of prize places, prize fund and rewards for the winners for each of the tournament are listed in the informational messages and on a tournament page.
9.7 Prizes are credited to player's balance automatically once the tournament is finished.
9.8 If there are users in a tournament with equal tournament points, then the highest place will belong to the user who was the first to finish the tournament.
COLLUSION, CHEATING, FRAUD AND CRIMINAL ACTIVITY
10.1 The following activities are not allowed and constitute a material breach of the Terms:
- Colluding with other third parties;
- Using unfair advantage or influence (commonly known as cheating), including the exploitation of a fault, loophole or error in our software, the use of automated players (sometimes known as 'bots'); or the exploitation of an 'error';
- Undertaking fraudulent activities to your advantage, including the use of a stolen, cloned or otherwise unauthorised credit or debit card, as a source of funds;
- Taking part in any criminal activities including money laundering and any offence with criminal repercussions.
- Transferring of funds from one player account to another.
10.2 We will take all reasonable steps to prevent such activities, detect them and the relevant players, and deal with the relevant players appropriately. We will not be liable for any loss or damage which you or any other player may incur as a result of collusive, fraudulent or otherwise illegal activity, or cheating, and any action we take in respect of the same will be at our sole discretion.
10.3 If you suspect a person is colluding, cheating or undertaking a fraudulent activity, please report it to us by e-mailing [email protected]
10.4 We reserve the right to inform relevant authorities, other online gaming or gambling operators, other online service providers and banks, credit card companies, electronic payment providers or other financial institutions of your identity and of any suspected unlawful, fraudulent or improper activity, and you agree to cooperate fully with us to investigate any such activity.
10.5 If user is suspected of being underage or swindler, the Netgame Casino administration may verify the user's personal data. If suspicions are confirmed, administration reserves the right to block account of such user, stop payments in favor of user and deny future access.
OTHER PROHIBITED ACTIVITES
10.1 You should not use the Website for any purpose which is considered to be defamatory, abusive, obscene, racist, sexist, discriminatory, or offensive. You must not use any abusive or aggressive language or images; swear, threaten, harass or abuse any other person, including other users, or behave in such a manner towards any company staff used to provide the Website or Support.
10.2 You shall not corrupt the Website, flood the Website with information so as to cause the Website to not function, nor use any features which may affect the function of the Website in any way for example (but not limited to) releasing or propagating viruses, worms, logic bombs or similar. Any multiple submissions or "spam" are strictly prohibited. You must not interfere or tamper with, remove or otherwise alter in any way, any information in any form which is included on the Website.
10.3 You shall use the Website for personal entertainment only and shall not be allowed to reproduce the Website or any part of it in any form whatsoever without our express consent.
10.4 You must not attempt to gain unauthorised access to the Website, the servers on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or similar. When breaching this provision we will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
10.5 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the Website or to Your downloading of any material posted on such Website, or on any website linked to the Website.
10.6 It is prohibited to sell, transfer and/or acquire accounts from other players.
CLOSURE AND TERMINATION BY US
11.1 Your Inactive Account will be terminated with written notice (or attempted notice) using your contact details. In the event of any such termination by us, other than where such closure and termination is made pursuant to paragraph 11 (Collusion, Cheating, Fraud and Criminal Activity) or paragraph 16 (Breach of the Terms) of these Terms, we will refund the balance of Your Account to you. If you cannot be located, the funds shall be remitted to the relevant gambling authority.
11.2 The Operator may refuse to open an account or may opt to close a players’ account which has already been opened at its own discretion.
11.3 In the event of any suspicious transaction/s, the Operator reserves the right to suspend or block a players’ account and withhold funds as may be required by law or the competent Authority.
ERRORS AND FAILURES
12.1 Where unexpected system flaws, faults or errors occur in the software or hardware which we use to provide the Website we will take immediate steps to remedy the problem.
12.2 We do not accept any liability for IT failures which are caused by your equipment used to access the Website or faults which relate to your internet service provider.
12.3 Neither we (including our employees or agents) nor our partners or suppliers shall be liable for any loss including loss of winnings that results from any Error by us or an error by you. You will forfeit any winnings/losses that result from any such Error.
EXCLUSION OF OUR LIABILITY
13.1 Your access to and use of the products offered via the Website, is at your sole option, discretion and risk.
13.2 We will provide the Website with reasonable skill and care and substantially as described in the Terms. We do not make any other promises or warranties the Website, or the products offered via the Website, and hereby exclude (to the extent permitted by law) all implied warranties in respect of the same.
13.3 We shall not be liable to You in contract, tort (including negligence) or otherwise for any business losses, including but not limited to loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not currently foreseeable by us arising out of the Terms or Your use of the Website.
14.1 You shall compensate us in full for any claims, liabilities, costs, expenses (including legal fees) and any other charges that may arise as a result of your breach of the Terms.
14.2 Where you are in material breach of the Terms, we reserve the right, but shall not be required, to:
14.2.1 Provide you with notice (using Your Contact Details) that you are in breach requiring you to stop the relevant act or failure to act;
14.2.2 Suspend your Account so that you are unable to place bets or play games on the Website;
14.2.3 Close Your Account with or without prior notice from us;
14.2.4 Recover from Your Account the amount of any payouts, bonuses or winnings which have been affected by any material breach.
14.3 We have the right to disable any user identification code or password if in our reasonable opinion you have failed to comply with any of the provisions of the Terms.
INTELLECTUAL PROPERTY RIGHTS
15.1 All website design, text, graphics, music, sound, photographs, video, the selection and arrangement thereof, software compilations, underlying source code, software and all other material contained within the Website are subject to copyright and other proprietary rights which are either owned by us or used under licence from third party rights owners.
